The process of acquisition of property by the government can either be a direct or indirect process. In a direct process, the government takes over property directly; whereas in an indirect process, the process is indirect wherein the government first seizes private property through an auction and later sells it to the end-user. It is only after an auction that the property is offered for public sale. For this reason, property acquisitions are handled differently at different levels of government. For instance, acquisition of property by the United States government through an auction is known as government real estate foreclosure sale; whereas acquisition of property by the Indian government is called government acquired property (AGP).

For acquisition of vacant land, the procedures used are basically the same as those used in auctioning. However, since the procedure does not involve an auction, the land becomes less attractive to potential buyers; hence less competitive. In a joint explanation delivered on 16 April, the Land Transport Authority (LTA), Singapore Land Authority (SLA) and Building and Construction Authority (BCA) said the structure must be procured and destroyed before unearthing works for the passage can initiate.

Before the seizure takes place, the owner is usually given time to remove himself from the area; however, if he fails to do so, then legal action is taken against him. The land can then be auctioned off. It is common for there to be public biddings for such lands; where interested bidders make a fixed deposit with the government, prior to bidding. The government makes the winning bid, and this tends to be determined by the kind of land being auctioned.

In mid 2020, preceding the beginning of development works inside the area, an effect evaluation investigation of the structure was led by LTA-delegated qualified people. The examination showed that the structure’s establishment should be fortified before removal works for the NSC passage could be begun.

The procedure is quite similar to that of the acquisition of land by the private parties. The first step in the process is to have the land surveyed by the government. The official then calculates the exact value of the land. If it is not in accordance with the prescribed norms, then the government can re-auction it. However, this rarely happens.

“To guarantee security during the fortifying works, LTA helped the inhabitants to move out of the structure,” they said.

There are certain requisites for such an acquisition, as the land needs to be open to public. A title search is also necessary, as is confirmation about the title of the land. After this the acquisition is finalized; and the land is acquired. But, this can only be done after due consultation with the tribal council. A customary agreement between the government and the tribal council is signed, and this states that the government will settle the debt of the land (which is settled by allotment) within a specific time, and that the land will revert to the original owner, if no payment is made for this.

By February this year, all inhabitants had moved out and had the option to get elective spots of home or business.

This type of land, which has been made accessible for sale to public, can either be developed or leased. It can also be used for agricultural purposes, like farming. The government has complete authority over the whole property; as it is the sole proprietor of the land.

From that point, nitty gritty tests were directed by LTA to approve the solid strength for the plan of the reinforcing works.

“These tests, which were intrusive in nature, must be directed after the tenants had cleared their units,” read the joint articulation.

The test outcomes showed that the solid strength of the structure was “lower than that expected to securely complete the fortifying works”.

This happens when the land is acquired from individuals or from any institution acting on their behalf. The land can be acquired for any purpose that the government might have in mind. Some areas, like deserts and mountains, can’t be accessed by any public transport system. Government transports the people who are interested in living there. Usually, these lands are sold off to individuals, though they also come under the category of common ownership, where the government is also an owner.

An autonomous investigation directed by BCA in February this year agreed with the evaluation of LTA that the structure was “alright for occupation if there was no significant development works nearby” and that it is unreasonable to do the fortifying works.

With this, the public authority chose to gain and destroy the structure.

SLA had effectively gazetted the obtaining of the influenced land on 16 April.

SLA and LTA said they will “work intimately with the influenced proprietors and help them through the obtaining cycle”.
